These terms are an agreement between you and Encore for your use of the Encore website, dashboard and Register app. By creating an account or using Encore you agree to them.
Accounts and artists
You must be at least 18 and able to enter a contract to create an account. You are responsible for your login, for the people you add to your team, and for everything done under your account.
Each artist in Encore is its own account for payments. The person who sets up payouts for an artist confirms they are authorized to do so on that artist's or company's behalf.
Fees and billing
Creating an account is free. Paid plans are charged per artist, only for calendar months that contain at least one scheduled show for that artist, at the price shown on our pricing page when the month is billed. Charges are made to the card saved in Billing and are non-refundable except where the law requires otherwise.
We will give account owners at least 30 days' notice by email before a price change applies to them.
Hardware purchases and rentals are priced at checkout. Rental deposits are refunded when the item is returned in working condition.
Card payments and payouts
Card payments and payouts are provided by Stripe. By setting up payouts you agree to the Stripe Connected Account Agreement. Card sales are made on the artist's own Stripe account, Stripe deducts its processing fees from that balance, and Encore takes no share of sales.
You are the seller of record for your merchandise and responsible for your products, pricing, refunds, sales tax, venue agreements and chargebacks.
Your data
You own the data you put into Encore. You give us permission to host, process and display it only to provide and improve the service, as described in our Privacy Policy.
If you collect fan email addresses through the Register, you are responsible for having permission to contact those fans and for honoring their unsubscribe requests.
AI features
MerchSense and the copilot generate answers and proposals from your data. They can be wrong. The copilot never changes anything without an admin's approval; review its proposals before you approve them. You remain responsible for decisions you make.
Acceptable use
- Do not use Encore to sell illegal, counterfeit or infringing goods.
- Do not try to access another artist's data, probe or overload the service, or get around its limits or security.
- Do not resell or white-label Encore without a written agreement with us.
Availability and changes
We work to keep Encore available, and the Register keeps recording sales offline when the connection drops. We may change or discontinue features; if we discontinue something you pay for, we will tell you in advance.
Ending your account
You can stop using Encore at any time; you will not be charged for months without shows. We may suspend or close accounts that break these terms or put other users or the service at risk. After closure you can ask for an export of your data for 30 days.
Disclaimers and liability
Encore is provided “as is”. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
To the extent the law allows, Encore is not liable for indirect, incidental, special or consequential damages or lost profits, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
Changes and contact
We may update these terms and will notify account owners by email before material changes take effect. Continuing to use Encore after that means you accept them. Questions go to support@atencore.com.
